Regulations FOR THE “AGRIAL 20 years” PHOTO CONTEST



Article 1 – Organising company:


The AGRIAL Agricultural Cooperative (hereinafter referred to as “AGRIAL” or “The Organising Company”), with variable capital of €57,636,133.30, listed in the Caen register of companies under number 428,611,719 and whose head office is located at 4 rue des Roquemonts 14000 Caen, is organising, from 6 January 2020 to 30 April 2020, a free photo contest with no obligation to purchase, entitled “AGRIAL 20 years Photo Contest” (hereinafter referred to as “the Contest”) via the website (hereinafter referred to as “the Website”).


Article 2 – Participants: 


Participation in the Contest is open to persons who meet all the following conditions:

  • natural persons who are of legal age
  • and who are members or employees of the Agrial cooperative and/or its subsidiaries during the Contest period,

hereinafter referred to as the “Participant”


Persons who do not meet the above conditions are excluded from the Contest. The Organising Company reserves the right to request proof of the above conditions from any participant.

The Organising Company undertakes to destroy and not to use the Contest entries of persons who do not meet the above conditions. The destruction of these entries will take place between 4 and 15 May 2020.


Participation in the Contest is individual; no group entries will be accepted.


Participation in the Contest implies full acceptance of these rules.


Article 3 – How to participate:


3.1 – Participation:


To participate in the Contest, the Participant must:

* access the website;

* fill in the participation form;

* and attach the photos, which must meet the criteria described in article 3.2 “Photos” below.


The form must be completed in full by the Participant, and the following fields are required: Title, Surname, First name, Email, Phone.


3.2 – Photos:


The theme of the Contest is Agrial’s 20th anniversary or the number 20.

The Participant may choose to participate in the Contest alone or in a group.

The Participant may post one or more photos to the Website.

The criteria for selecting the photos are as follows: staging, creativity, originality and the place chosen by the participant.


Photo(s) must be sent in high definition, in gif, jpg, png, svg formats.


Article 4 – Determining the winners:


4.1 – Short-listed photos:


The Contest organising committee will produce a short-list of photos between the end of the contest and the meeting of the jury, from 4 to 15 May 2020.


4.2 – Determining the winners:


The photos short-listed by the Contest organising committee will then be presented to the jury between 18 May and 5 June 2020.


The jury is composed of members of the Agrial Cooperative Life Commission.


The jury will determine the winners of the Contest (hereinafter referred to as the “Winner(s)”).


The Winners will be determined objectively, with no bias, and will be judged solely on the basis of the criteria (defined in article 3.2) for selecting the photo(s) submitted by the Participants.


The jury’s deliberations and the announcement of the Winners will take place after 5 June 2020.



The names of the Winners will be published on the Website. Winners will be notified personally by telephone or email after 5 June 2020.


4.3 – Winner distribution


There will be 18 winners, distributed as follows:

Four major winners: 2 Members / 2 Employees (1 drone and 1 GoPro)

+ 14 winners among regional members, 1 per region (1 weekend box gift for two).


If no members from a given region have participated, the jury reserves the right to award the prize to another participant.


Article 5 – Prizes:


The Contest winners will receive the following prizes:


  • 2 drones with an indicative unit value of approximately €663 including VAT
  • 2 black GoPros with an indicative unit value of approximately €330 including VAT


  • 14 weekends for two with an indicative unit value of approximately €69.90 including VAT

(Transport and meals not included).

The Organising Company reserves the right to replace the prizes with an equivalent prize of the same value and similar characteristics. The company disclaims all liability in this regard.


Article 6 – Presentation of prizes to the Winners:


Once the Winners have been personally notified by the Organising Company, by telephone or email after 31 May 2020, the prizes will be awarded in accordance with the following terms and conditions.


6.1 – Member winners will receive their prizes on Friday 12 or Friday 19 June 2020:

  • either during the Wide Angle Day in Marigné Peuton on 12 June 2020;
  • or during the Wide Angle Day in Vieux-la-Romaine on 19 June 2020.


6.2 – Employee winners will receive their prizes at a location to be determined with the Organising Company. If they are unable to travel, Employee Winners may receive their prizes from the Organising Company by post or at AGRIAL’s head office in Caen.


Article 7 – Participants’ guarantee:


1.1 – Each Participant declares that they are the author of the photographs they submit, that they hold full exploitation rights over them, and warrants to the Organising Company that the photographs submitted are original creations that do not infringe the rights of third parties (copyright, right to privacy, right to image, trademark rights, etc.).


If any persons appear in the photographs, the Participant warrants that such persons are of legal age and that they have obtained their express prior consent to the use of such photographs in the Contest; if there are any minors, the Participant warrants that they have obtained prior consent from their legal representatives. The Organising Company may not, under any circumstances, be held liable in this regard.


Consequently, the Participant undertakes to assume personal responsibility for any claim, suit, dispute or action that may be brought by any third party, regardless of its basis.


The Participant finally guarantees that:

  • the submitted photographs do not contain any viruses or any destructive or harmful content;
  • the submitted photographs do not contravene any laws in force and/or go against public morals and order.

The Organising Company reserves the right not to use any photograph that goes against the conditions of this Contest and in particular the provisions of this article.


Article 8 – Use of the photographs at the end of the Contest:


By participating in the Contest, the Winners as determined in article 4.2 above authorise the Organising Company to reproduce and distribute the photograph(s) selected by the jury, for non-commercial purposes, on the website, until 31 December 2021.

Said photographs must always be accompanied by the name of their author.


The Organising Company undertakes not to transfer said exploitation rights to third parties and not to use said photographs for any other purpose without the prior agreement of their author.


Article 9 – Personal data:


In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, amended, and the provisions of the General Data Protection Regulations (EU 2016/679 of 27 April 2016), the data collected (surnames, first names, email address and telephone numbers) are strictly necessary for the proper execution of the Contest, for contacting the Participants in the context of the Contest and for awarding the prizes to the Winners.

In order to participate in the Contest, the Participant must accept the Rules and the collection of such data.

The Participant is informed that all the information requested in the Contest entry form is mandatory and indicated as such, and that failure by the Participant to provide this information will impede their participation in the Contest.

Consequently, the collected data are only transmitted to the Organising Company and its agency PUBLICIS ACTIV.

All Participants also have the right to access, rectify, restrict processing, erase and transfer their personal data by contacting the Organising Company directly by email to or by post to Service communication – 4 rue des Roquemonts – CS 35051 – 14050 CAEN Cedex 4. For security reasons and to avoid fraudulent requests, this request must be accompanied by a proof of identity. After processing the request, this document will be destroyed.

It is specified in this regard that any request to delete these data by any means whatsoever during the duration of the Contest may result in the cancellation of the registration for the Contest.

At the end of the Contest and after ensuring that the Winners have correctly received their prizes, the Organiser undertakes to destroy the collected data by 31 July 2020 at the latest.


ARTICLE 10 – Liability:


The liability of the Organising Company is strictly limited to the delivery of the prizes actually and validly won.

The Organising Company disclaims all liability for any malfunctions of the Internet, telephone lines and reception equipment that prevent the smooth running of the Contest. In addition, it cannot be held liable under any circumstances for problems with the delivery or loss of electronic or postal mail.

The Organising Company disclaims all liability in the event of any technical failure, anomaly, hardware and software failure of any kind (virus, bug. etc.) caused on the Participant’s system.

The Organising Company reserves the right to shorten, extend, postpone, modify or cancel this Contest as the circumstances require. In any event, it cannot be held liable in this regard. In such circumstances, the Organising Company will set up the technical means needed to inform the Participants via the Website.

The Organising Company shall make every effort to allow access to the Contest on the Website at any time, without being under any obligation to do so. The Organising Company may, at any time, in particular for technical reasons, for updates and maintenance, interrupt access to the Website and the Contest it contains.

The Organising Company shall not, under any circumstances, be held liable for these interruptions and their consequences.

No disputes or claims made more than two months after the end of the Contest will be accepted. No requests for information regarding the Contest, in writing or by telephone, will be answered.

The Organising Company shall not be held liable for any incidents that may occur as a result of using the prizes awarded.


Article 11 – Amendment of the Rules:


The Organising Company reserves the right to cancel, postpone, extend, shorten or modify the Contest, in whole or in part, if circumstances require it to do so without having to justify this decision and without being held liable in any way as a result. Every amendment will be announced on the Website.


Article 12 – Disputes:


These Rules are subject to French law.

In order to be taken into account, any disputes relating to the Contest must be sent in writing to the address of the Organising Company at the latest 2 months after the end of the Contest.

Any disputes arising from this Contest that cannot be settled amicably will be submitted to the courts of NANTES.
